The Court of Cantabria will hear evidence from today, Wednesday, against a mad who allegedly tried to force a 10-year-old girl into a lift with the intention of sexually assaulting her, although the child fought back, hitting him in the head with a frying pan she had just bought.
The facts, according to the Prosecutor’s Office, deserve a sentence of 4 years in prison and a fine of 360 euro for a crime of attempted sexual assault and another minor injury, with the concurrence of the aggravating circumstance of criminal responsibility of recidivism.
The defendant, “with a criminal record and numerous sentences for sexual crimes,” says the prosecutor, approached the minor in her doorway and told her to get into the elevator holding her “strongly” by the wrist.
The girl refused, began to scream and hit him on the head with a frying pan she had just bought, whereupon he grabbed her tightly by the ponytail and punched her in the nose and mouth before running away “without being able to fulfil his purpose,” says the prosecution.
In addition to the prison sentence and a fine, it is requested that a ban on communicating with and approaching the minor be imposed for ten years, probation after release for seven years and disqualification from any profession or trade that involves contact with minors for nine years.
In terms of civil liability, the prosecution requests that he be sentenced to pay compensation to the minor of 3,150 euro for the injuries and moral damage caused.
For its part, the private prosecution filed by the minor’s family raises the request for a sentence of six years in prison and a fine of 540 euro, removal and prohibition of communication with her for sixteen years, probation for ten years and disqualification from profession. with minors for eleven years.
The compensation requested by the private prosecution is the same as that requested by the public prosecutor’s office.
